1. Acceptance of terms
By accessing or using emailr ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of service
emailr provides email infrastructure services including transactional email delivery, marketing email campaigns, email validation, and related analytics. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Account registration
You must provide accurate, complete, and current information when creating an account. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Acceptable use
You agree not to use the Service to send spam, phishing emails, or malware. You must comply with all applicable laws including CAN-SPAM, GDPR, and other anti-spam regulations. You must maintain proper consent for all email recipients. Violation of these terms may result in immediate account termination.
5. Payment terms
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change our prices with 30 days notice. Failure to pay may result in suspension or termination of your account.
6. Intellectual property
The Service and its original content, features, and functionality are owned by emailr and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any content you submit through the Service.
7. Limitation of liability
In no event shall emailr be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless emailr and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these terms.
9. Termination
We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these terms. Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time through your account settings.
10. Governing law
These terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
11. Changes to terms
We reserve the right to modify these terms at any time. We will provide notice of significant changes by email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new terms.
